Full Terms and Conditions for Tomatin Distillery’s ‘Name the Cocktail’ Competition
By participating in the promotion, entrants agree to be bound by these terms and conditions and any other requirements set out in the promotional material. Keep a copy for your records.
Promoter: Tomatin Distillery, Tomatin, Inverness-shire IV13 7YT. No correspondence to this address please.
Eligibility:
1. Entrants of Tomatin’s Belladrum cocktail naming competition must be aged 18+ years or of legal alcohol purchasing age in the country in which they reside.
2. Entrants must have a valid Instagram account and fulfil the entry criteria outlined below.
Promotional Period:
3. The Belladrum cocktail naming competition will run from 16 June 2025 – 25 June 2025
How to Participate in the Promotion:
4. To participate in the Belladrum cocktail naming promotion, participants must follow the Tomatin Whisky Instagram page and comment their cocktail name suggestion on Tomatin Whisky’s Belladrum Cocktail naming post
5. Submissions must be received by 23.59 on 25 June 2025
6. Entrants may enter multiple submissions.
The Prize:
7. The winner of the cocktail naming competition will receive 2x tickets to Belladrum Festival 2025
Decision of the Winner:
8. The winning cocktail name and awarding of the prize will be at the discretion of the Tomatin Distillery marketing team. It will be decided by a committee of at least two individuals, neither of whom will have any affiliation with the entrants of the competition.
Contacting the Winner:
9. The winner will be contacted on Instagram by the Tomatin Distillery Instagram account (@tomatin.whisky) within 3 working days of the competition ending (28 June 2025).
Accepting the Prize:
10. The winner has 24 hours from the time the Instagram message is sent to accept the prize. In the event that the winner does not accept the prize within 24 hours, Tomatin Distillery reserves the right to retract the prize and select another winner.
General:
11. Tomatin Distillery reserves the right to verify all entries and refuse further participation in the promotion and disqualify the entrant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements. Tomatin Distillery will be the final arbiter in any decisions and these will be binding.
12. In the event of circumstances outside the reasonable control of the promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the distribution of bottles within the promotion and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
13. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
14. Participants will fully release and hold Instagram, Facebook, Meta and Belladrum Festival harmless from liability and acknowledge the promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram, or Meta.
15. By participating in the promotion the entrants herby grant the Promoter, and assigns the absolute and irrevocable right and permission to photograph and video the participant and assigns the absolute and irrevocable right and permission to use, re-use, publish, re-publish, publicly display, perform, transmit, exhibit, and reproduce by name, country of origin, statements, photographs, or other visual representations or likeness, in whole or in part, individually or in conjunction with other material, including without limitation, text, photographs, or images, in any medium including, but not limited to the internet and other electronic media, and for any purposes, including but not limited to advertising, publicity, promotion, and trade, throughout the UK and rest of world without restriction as to manner, frequency, or duration of usage or any other purpose whatsoever in connection with the sale and marketing of the promoter’s products.
16. The Promoter accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Belladrum Cocktail Naming promotion. Nothing in these terms and conditions shall exclude the liability of the promoter limited for death or personal injury as a result of its negligence or for fraud or fraudulent misrepresentation.
17. The Promoter will process customers’ personal data in accordance with its Privacy Notice at https://tomatin.com/privacy-policy/
18. Participants that do not comply with these terms and conditions, or where participants are found to be abusing the promotion in any way, will result in the disqualification of all relevant purchases.
19. The Promoter’s decision is final in relation to all promotional matters.
20. Any question concerning the legal interpretation of the rules will be based on Scottish law and the Courts of Scotland will have exclusive jurisdiction.
