Full Terms and Conditions for Tomatin Distillery’s Mystery Whisky Promotion

By participating in the promotion, entrants agree to be bound by these terms and conditions and any other requirements set out in the promotional material. Keep a copy for your records.  

Promoter: Tomatin Distillery, Tomatin, Inverness-shire IV13 7YT. No correspondence to this address please. 

Eligibility:

1. Purchasers of Tomatin’s mystery whisky must be aged 18+ years or of legal alcohol purchasing age in the country in which they reside.
2. As part of Tomatin’s commitment to responsible drinking, no more than 5 mystery whisky bottles can be purchased per customer.

Promotional Period:

3. The mystery whisky promotion will run from 23 May 2025 – 13 June 2025 or while stocks last.

How to Participate in the Promotion:

4. To receive a bottle from the mystery whisky promotion, customers must purchase our ‘mystery whisky’ product from the tomatin.com online shop.

The Products:

5. Products received in the mystery whisky promotion are broken down into two tiers, dependent on which tier the customer purchases. These are outlined by tier on both the product page and below:

Gold Tier:

• Tomatin 30 year old
• Italian Collection Barolo Edition
• Tomatin 14 year old
• Italian Collection Amarone Edition
• Italian Collection Marsala Edition
• Sherry Collection Manzanilla Edition
• Cù Bòcan 12 year old

Platinum Tier:

• Tomatin 36 Year Old Bourbon and Sherry
• Sherry Collection Palo Cortado Edition
• Cù Bòcan 15 Year Old
• Tomatin 18 Year Old Oloroso Sherry

Bottle Allocation:

6. Bottles are allocated to customers at random according to which tier of mystery whisky they purchase. Neither Tomatin Distillery nor MMUK (shop operator), have any influence over the bottle(s) a customer receives within the promotion. Customers may receive one or more of the same bottle due to the random allocations. For example, if a customer orders 4 bottles of platinum mystery whisky, this does not guarantee them one of each bottle in the platinum tier.

General:

7. Any references to “£10 minimum saving on each bottle” (or similar) refer in comparison to the recommended retail value of the bottle as listed on the tomatin.com online shop.
8. Bottles received in the mystery whisky promotion may not be exchanged with Tomatin Distillery for another bottle in the mystery whisky promotion in the event that the customer does not ‘like’ the bottle received.

10. Tomatin Distillery reserves the right to verify all purchases and refuse further participation in the promotion and disqualify the customer where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements. Tomatin Distillery will be the final arbiter in any decisions and these will be binding. 
11. In the event of circumstances outside the reasonable control of the promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the distribution of bottles within the promotion and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
12. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. 
13. Participants will fully release and hold Instagram, Facebook and Meta harmless from liability and acknowledge the promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram, or Meta. 
14. The Promoter accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the mystery whisky promotion. Nothing in these terms and conditions shall exclude the liability of the promoter limited for death or personal injury as a result of its negligence or for fraud or fraudulent misrepresentation. 
15. The Promoter will process customers’ personal data in accordance with its Privacy Notice at https://tomatin.com/privacy-policy/  
16. Participants that do not comply with these terms and conditions, or where participants are found to be abusing the promotion in any way, will result in the disqualification of all relevant purchases. 
17. The Promoter’s decision is final in relation to all promotional matters. 
18. Any question concerning the legal interpretation of the rules will be based on Scottish law and the Courts of Scotland will have exclusive jurisdiction.
